that will succeed. >> senator dianne feinstein who sponsored the ban was clearly irritated. the california democrat told reporters, obviously, i'm disappointed. i tried my best but my best i guess was not good enough. you'd think congress would listen but they clearly listened to the national rifle association and they do. the ban would have outlawed it nearly 160 semiautomatic weapons and limited the size of magazines to ten rounds. and in today's "daily news" a removal of the assault rifle ban saying, quote. any fool knows that ryan lanza couldn't have possibly have killed as many children as quickly as he did on this morning december 14th without an assault weapon in his hand. so how does the president and any big if not now for a ban on these weapons, when? if sandy hook elementary doesn't make every member of congress take a stand against assault weapons in this country, then what does? this moment, the moment of newtown, of sandy hook, elementary, should not be lost because if it is, maybe it is lost forever. it was officially lost in washington on tuesday, lost to fear and lost to ignorance

and paint it before you get there. >> well, maybe so. yesterday, senator feinstein said the assault weapons ban is not going to be part of the bill. that's something you've been predicting for a while. i've been talking about for a couple weeks now. what are the chances we see it as added as an amendment possibly down the road. >> there's no doubt there'll be efforts to add it, i think this is the official death of the assault weapons ban. it's harry reid conceding it can't be part of the main bill. they're trying to focus on what is doable. what can they get done in april? and what they think can get done would be universal background checks, including for private transactions. if i was going to sell you a gun that doesn't have to be any sort of background check on that under a bill being knocked around in the senate, you would have to have some validation there before that purchase could be made. and that's the sticking point right now. that's a far cry from what democrats were talking about two or three months ago. that's a pretty small, narrow provision in the scope of all the big gun c

that senator feinstein and i have taken in a public release that we issued about a year ago that the claims that some make from cheney on down that the use of waterboarding led to useful information are false. those claims are not accurate. and i can only tell you we have publicly laid out our case that they're not accurate in a release that the two of us signed and issued about a year ago, and it's available on our web sites so you can kind of see it there. but what you can't see unless the cia cooperates is a very, very detailed history of the use of abusive tactics, what the administration then in power called enhanced interrogation techniques, some of which are torture under international law including waterboarding. i had a, i, frankly, had a lot of trouble with brennan when he was confirmed because he would not acknowledge that waterboarding is torture even though it is torture under international law, under geneva, according to our president. obama has said it is torture, it is. and, but to your point it's not just torture, it's not useful. it doesn't and did not produce, did not pro
